Welcome to Mimic. These Terms of Service ("Terms") govern your use of the Mimic website and services operated by Mimic ("we," "us," or "our") at usemimic.app.

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the service.

• You must be at least 13 years old to use this service
• You must provide accurate and complete registration information
• You may only maintain one account per person or entity
• You are responsible for maintaining the security of your account and password
• You must notify us immediately of any unauthorized access or security breach
• Automated account creation (bots, scripts) is prohibited
• If you are located in the EU/EEA, you must be at least 16 years old to use this service in accordance with GDPR requirements
• If you use Mimic on behalf of a company or organization, you represent and warrant that you have authority to bind that entity to these Terms, and "you" refers to both you individually and that entity

Mimic provides:

• AI Voice Matching: Analysis of your Twitter history to create a voice fingerprint (linguistic profile)
• Content Generation: AI-powered tweet creation that matches your voice
• Scheduling: Queue management and automated publishing to Twitter/X
• Analytics: Tracking of generation and publishing activity

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. Feature availability may vary by subscription plan.

• Subscription plans and pricing are listed on our pricing page
• Payments are processed securely by Polar.sh
• Subscriptions automatically renew unless cancelled
• Prices may change with 30 days' notice for existing subscribers
• All fees are exclusive of taxes where applicable
• Failed payments may result in service suspension

• You may cancel your subscription at any time through your account settings or the Polar.sh customer portal
• Cancellation takes effect at the end of your current billing period
• You retain access to paid features until the end of your billing period
• Refunds are generally not provided for partial billing periods
• If you believe you are entitled to a refund due to service issues, contact us at support@usemimic.app

Important: AI-generated content requires human review before publishing.

• Generated tweets are suggestions that may require editing
• We do not guarantee any specific engagement results, viral reach, or follower growth
• You are solely responsible for content you publish to Twitter/X
• AI outputs may occasionally be inaccurate, off-topic, or require adjustment
• Voice matching accuracy depends on the quality and quantity of your past tweets

Mimic integrates with third-party services. By using Mimic, you also agree to:

• Twitter/X: Twitter Terms of Service — You must comply with Twitter's policies when using our publishing features
• Polar.sh: Payment processing terms for subscription management

We are not responsible for the availability, accuracy, or policies of third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE
• UNINTERRUPTED or ERROR-FREE service
• ACCURACY of AI-generated content
• SECURITY from unauthorized access

We do not guarantee that our service will meet your requirements or achieve any particular results.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIMIC SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or reputation
• Damages resulting from unauthorized access to your account
• Actions taken by Twitter/X against your account based on content you published

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Mimic and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the service
• Content you publish through our platform
• Your violation of these Terms
• Your violation of any third-party rights

We may update these Terms from time to time. We will notify you of material changes by:

• Posting updated Terms on this page
• Updating the "Last updated" date
• Sending email notification for significant changes

Continued use of the service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved in the courts located in Delaware, and you consent to personal jurisdiction in those courts.

Mimic shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, acts of God, or severe weather events
• War, terrorism, civil unrest, or government actions
• Epidemics, pandemics, or public health emergencies
• Internet or telecommunications failures
• Third-party service outages (including Twitter/X API, cloud providers, or payment processors)
• Cyberattacks, DDoS attacks, or security incidents
• Power outages or infrastructure failures

During such events, our obligations under these Terms will be suspended for the duration of the force majeure event.

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations (EAR) maintained by the U.S. Department of Commerce and sanctions programs administered by the U.S. Treasury Department's Office of Foreign Assets Control (OFAC).

You may not use or access Mimic if you are located in, or a national or resident of, any country subject to comprehensive U.S. sanctions, or if you are on any U.S. government restricted party list.
